法律继受也称法律移植，是一种不同法系、不同法律制度以及不同法律文化之间相互交流的主要形式，在许多国家的法律发展史上都可以多多少少地找到法律继受的痕迹。因此，法律继受不仅成为学者们的关注对象之一，而且也成为许多国家建立和完善本国法律体系的一种主要手段。
日本自古以来就以擅长吸收他国长处而著称，这种特征同样也表现在对待法律制度和法律文化的态度上。日本古代就曾经大规模地继受中国古代的法律制度和法律思想，由中国继受而来的律令法，律令法与日本武士的统治习惯融合而成的武家法构成日本近代之前的主要法律传统。明治维新时期，日本在“脱亚入欧”思想的引导之下，全面地、概括性地继受以德国法和法国法为主的西洋法，从而使日本法在结构上或形式上完全切断了与传统法律制度的联系，具备了与西洋法完全相同的外观。第二次世界大战之后，日本又开始在宪法等多个部门法领域继受美国法，使以欧洲大陆法为基础的近代日本法中添加进许多美国法的因素。如果仅从这个角度来考察日本法，可以说日本的法律史就是一部法律继受的历史。
日本先后三次成功的法律继受不仅丰富了有关法律继受的研究素材，而且其对不同法系、不同法律文化的法的继受又扩大了研究法律继受问题的视野。更为重要的是，日本较为成功的法律继受还可以为其他希望通过借鉴、吸收他国法律制度或法律文化中的“精华”来完善本国法律体系的国家提供了许多活生生的经验和教训。这一点对于与日本同文同种，又在为建设和完善社会主义法律体系而注重吸收、借鉴外国先进经验的我国来说更具有实践意义。
正是出于这种考虑，自上个世纪90年代中期起，中国政法大学比较法研究所和日本中央大学日本比较法研究所在日本国际交流基金会的资助下，先后四次就相关课题设立共同研究项目，开展共同研究，并取得了一定的成果。
