C309 新营业条款
如果在第一个营业年度结束前在保险地点内发生损失索赔，则毛利润率、年度营业额，标准营业额以及工资率应定义如下：
毛利润率：从营业开始至损失发生日期间，所实现的毛利润对营业额的比率；
年度营业额：从营业开始至损失发生日期间所实现的营业额，按十二个月比例折算；
标准营业额：从营业开始至损失发生日期间所实现的营业额，按赔偿期限比例折算；
工资率：从营业开始至损失发生日期间，工资对营业额的比率；
上述数额或比率必要时应根据营业趋势及情况的变化，或损失发生前后业务受影响情况，或如未发生损失原会影响业务的其他情况予以调整，使调整的数额尽可能合理地接近在出险后有关期间如未发生损失原可取得的经营结果。
注释：如果被保企业是个全新的企业，其利损险保单下应附加此条款。
E309 New Business Clause
For the purpose of any c1aim arising from damage occurring before the completion of the first Year's trading of the business at the premises the terms rate of gross profit, annual turnover and standard turnover shall bear the following meanings and not as within stated.
RATE OF GROSS PROFIT - The rate of gross profit earned on the turnover during the period between the date of the commencement of the business and the date of the damage;
ANNUAL TURNOVER - The proportional equivalent, for a period of twelve months, of the turnover realized during the period between the commencement of the business and the date of the damage;
STANDARD TURNOVER - The proportional equivalent, for a period equal to the indemnity period, of the turnover realized during the period between the commencement of the business and the date of the damage;
RATE OF WAGES - The rate of wages to turnover during the period between the date of the
commencement of the business and the date of the damage;
To which such adjustments shall be made as may be necessary to provide for the trend of the business and for variations in or other circumstances affecting the business either before or after the damage or which would have affected the business had the damage not occurred so that the figures thus adjusted shall represent as nearly as may be reasonably practicable the results which but for the damage would have been obtained during the relative period of the damage.
