(a) Communication: Notification, Consultation and Negotiation
Art. 8 of the Convention reinforces the need for communication by institutionalizing a general obligation to cooperate. In discussing the kind of cooperation arising from the obligation to cooperate it would be helpful to clarify some of the relevant terms. Perhaps the best approach is to consider notification, consultation and negotiation on a continuum of governmental interaction. Notification is referred to in arts. 12, 13, 15 16 & 18. While notification per se simply requires the providing of information without a mutual exchange, some types of notification under the convention, such as those referred to under art.17, are tied to a further requirement of consultation and negotiation.
